PRESENTATION SUMMARY

Employers must classify workers as either independent contractors or employees and employees as exempt or nonexempt from minimum wage and overtime laws. With an increased focus on enforcement, including the addition of 100 Department of Labor wage and hour investigators, it is more important than ever to make these classifications properly. This session will provide you with the tools you need to do exactly that.


Learning objectives:

  • Understand the difference between employees and independent contractors and the legal standards that govern.
  • Understand the difference between exempt and nonexempt employees and the legal standards that govern.
  • Understand the importance of correctly classifying workers in these categories, including penalties for misclassification.


SPEAKER BIO

Jennifer A. Powell is a shareholder in the law firm of Eichelbaum Wardell Hansen Powell & Muñoz, P.C. Jennifer’s practice focuses on a wide range of labor and employment, constitutional, and civil rights issues, as well as school law. Jennifer has represented businesses, non-profits, and governmental entities since 1992. Jennifer handles matters from the administrative level through the appellate process in both state and federal venues.


Jennifer has been Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization since 2001, and she has an AV rating in Martindale Hubbell's Legal Directory, the highest rating given to attorneys.
